DIFC Court – Jurisdiction Update

The law which defines jurisdiction of the Courts of the Dubai International Financial Centre (DIFC Court) was amended on 31 October 2011 according to the Court's press release. The change in the law allows parties in the region and internationally to incorporate freely the jurisdiction of DIFC Court into their contracts.
Prior to the amendment, the parties did not have a freedom to appoint the DIFC Court as their forum of choice and instead they had to bring their case within a limited number of jurisdictional gateways, which effectively restricted the use of the Court to DIFC-related matters only. The expansion of the DIFC Court's jurisdiction will give the business community an access to the court which is staffed with internationally recognised judges.
The DIFC Court conducts its proceedings in English and the Court's procedural rules is largely modelled on English Civil Procedure Rules.
