New Bribery Law delayed

The Bribery Act will not now come into force in April 2011. The government guidance on 'adequate procedures', which will be the cornerstone of any defence to the corporate offence of failure to prevent bribery, was not published in January, and the Ministry of Justice has confirmed that there will be a three month lead period between the publication of the guidance and the implementation of the Act.

In the meantime the Act is being reviewed by the Government as part of its 'growth review'. It seems unlikely, however, that this will lead to any major changes; indeed there are signs of increasing international pressure on the UK for swift and complete implementation.

Businesses would still do well, therefore, to familiarise themselves with the principles of the Act and the measures which are likely to be required, notes partner Andrew Ottley (pictured).
