She acts for shipowners, P&I Clubs and underwriters, advising on contracts of carriage, general average and cargo claims and the arrest of vessels, bunkers and other assets. Marie Noëlle's Admiralty experience includes handling pollution and collision cases.
Recent cases include:
- advice on contract of tonnage for shippers
- advice on a heavy units transportation contract for forwarding agent
- involvement in cases related to contamination/pollution products such as chemicals, for cargo underwriter; mineral water, for a major French shipper; champagne for a carrier, including attendance of court survey
- advice on applicable law in respect of river carriage
- advice on general average issues.
Marie-Noëlle is experienced in handling claims cases, in defence or in demand, including assisting the client in court survey proceedings.
Recent cases include:
- litigation with a car repairer in relation to the repairs of 4500 new cars stored on a terminal and damaged by hail
- litigation with a yard for a marine supplier in relation with the refurbishment of a vessel
- acting for an underwriter in relation to inherent vice of wagons.
Marie-Noëlle has wide experience in analysis of war risks policy, reinsurance policy and handling litigation on insurance issues under French law.
Recent cases include:
- analysing oil major company reinsurance programme for determination of the exposure of the reinsurers
- handling a dispute between underwriters in respect of cumulative insurance.
